Leading Midwifery Care ("we", "us", "our") is committed to protecting your privacy and handling your personal and health information with care. This policy explains what information we collect, how we use it, who we share it with, and your rights.

We handle personal information in accordance with the Privacy Act 2020 and, because we are a health provider, the Health Information Privacy Code 2020 when we handle health information.

1. What this policy covers

This policy applies to information we collect:

  • from the women, whānau and clients in our care;

  • from people who contact us, enquire about our services, or register with us;

  • from people who buy our digital products (such as our pregnancy guide) or enter a promotion; and

  • from visitors to our website.

2. The information we collect

Depending on how you interact with us, we may collect:

Health and clinical information (for those in our care) — your medical, pregnancy, birth and postnatal history; test, scan and screening results; the care we provide; and information about your baby and whānau relevant to your care.

Contact and identity information — your name, address, phone number, email, date of birth, and NHI number where relevant.

Transaction information — details of products you purchase (such as our guide), and giveaway or promotion entries. Card payments are processed by our payment provider; we do not store your full card details.

Website and technical information — information collected automatically when you visit our website, such as your device and browser type, IP address, pages viewed, and cookie data (see section 9).

3. How we collect it

We collect information:

  • directly from you — in person, by phone, email, our contact or registration forms, or at checkout;

  • from other health providers involved in your care (for example your GP, a hospital, laboratory or specialist), where you have authorised this or the law allows it; and

  • automatically, through our website and analytics tools.

Wherever practical, we collect information directly from you. If you choose not to provide certain information, we may not be able to provide you with care or a service.

4. Why we collect and how we use your information

We use your information to:

  • provide, coordinate and follow up your midwifery care;

  • arrange tests, scans, referrals and hospital or specialist involvement;

  • keep accurate clinical records as required by law and professional standards;

  • respond to enquiries and manage your registration with us;

  • process purchases, deliver digital products, and run promotions;

  • meet our legal, professional and funding obligations; and

  • improve our website and services.

We only use your health information for purposes connected with your care, or as otherwise permitted under the Health Information Privacy Code 2020.

5. Sharing your information

We treat your information as confidential and only share it where appropriate. We may share information with:

  • other health providers involved in your care — for example hospitals and birthing facilities, your GP, obstetricians and other specialists, laboratories and radiology, and Well Child / Tamariki Ora providers such as Plunket;

  • Te Whatu Ora – Health New Zealand and the Ministry of Health, where required for funding, screening programmes, or statutory reporting;

  • our trusted service providers — such as our website, payment, email and data-hosting providers — who handle information on our behalf under confidentiality obligations (see section 6); and

  • others where the law requires or authorises it, or to prevent a serious threat to someone's health or safety.

We do not sell your personal or health information.

6. Third-party services

We use reputable third-party providers to run our clinic and website, which may include [Squarespace/The Growth Studio], [stripe], [google.com]. These providers may store or process information on secure servers that are located in New Zealand and/or overseas. Where information is held overseas, we take reasonable steps to ensure it is protected by comparable safeguards.

7. Storage, security and retention

7.1. We take reasonable steps to keep your information safe from loss, misuse and unauthorised access, use or disclosure.

7.2. We keep health information for at least the period required by the Health (Retention of Health Information) Regulations 1996 (generally a minimum of 10 years), and other information only for as long as we need it for the purposes described above or to meet our legal obligations.

8. Your rights access and correction

8.1. You have the right to ask for a copy of the personal or health information we hold about you, and to ask us to correct it if it is wrong.

8.2. To make a request, contact us using the details at the top of this policy. We may need to confirm your identity before releasing information. We will respond within the timeframes set by the Privacy Act 2020 and Health Information Privacy Code 2020.

8.3. If we cannot correct information as you have asked, you may request that a statement of the correction you sought be attached to the information.

9. Cookies and analytics

Our website uses cookies and similar technologies to help the site work, remember your preferences, and understand how the site is used so we can improve it. You can control or disable cookies through your browser settings, though some features may not work as well if you do.

10. Marketing and your choices

We will only send you marketing communications (such as newsletters or product updates) if you have opted in to receive them. You can unsubscribe at any time using the link in our emails or by contacting us.

11. Children and young people

Some of the people in our care are young people. We handle their information with particular care and in line with our legal and professional obligations. Our website and online store are intended for use by adults.

12. Privacy breaches

If a privacy breach occurs that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act 2020.
